Terms of Service

Last updated: April 2026 · These terms govern your use of the Fluxive managed phishing-simulation and awareness-training service.

Summary: You subscribe to a managed service. We send simulated phishing emails to employees you designate, generate AI-personalised training for those who need it, and provide you with documentation reports. You agree not to use the service to attack third parties. Either party can end the subscription with 30 days' notice.

1. Who we are

Fluxive BV, a company registered in Belgium with BTW number BE1029968269 and registered office in Ninove 9400, Belgium, provides the Fluxive service ("we", "us", "our"). You ("you", "customer") are the legal entity that signs up for a Fluxive subscription.

2. The service

Fluxive is a subscription service combining realistic phishing simulations with AI-generated micro-lessons for employees. Specifically, Fluxive:

3. Not a legal certification

Fluxive produces supporting documentation for your internal NIS2 Article 21(2)(g) awareness-programme records. Fluxive does not issue legal certifications, CCB accreditations, or formal compliance-audit conclusions. The decision to accept a Fluxive report as evidence for any audit or regulatory process rests with the auditor, regulator, or insurer in question.

You may use Fluxive only against employees of your own organisation (or of group-affiliated entities you have the authority to include). You may not:

5. Subscription and cancellation

Subscriptions renew monthly unless cancelled. Either party may cancel with 30 days' written notice, effective at the end of the next billing cycle. Annual subscriptions renew for another year unless cancelled at least 30 days before the anniversary date.

Setup fees and fees for services already rendered are non-refundable. No refunds are issued for partial months.

6. Data processing

We process personal data of the employees you designate (name, work email, department, language preference, and event data — opens, clicks, submissions) strictly to deliver the service. Data is processed in the EU and stored for the duration of your subscription plus a 90-day archival period.

7. Confidentiality

Both parties agree to keep non-public information received from the other confidential and to use it only for the purpose of delivering or using the service. This obligation survives termination of the subscription for three years.

8. Warranty and liability

The service is provided "as-is". We make no warranty that a specific phishing simulation will not be blocked by an email provider, that training reports will be accepted by any specific auditor or insurer, or that the service will prevent any particular security incident.

Our aggregate liability to you for any claim arising from the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. This limitation does not apply to wilful misconduct, gross negligence, or any liability that cannot be limited by Belgian law.

9. Changes to these terms

We may update these terms from time to time. Material changes will be notified to you by email at least 30 days in advance. Your continued use of the service after the effective date constitutes acceptance. If you do not accept the changes you may cancel as described in section 5.

10. Governing law

These terms are governed by Belgian law. Any dispute arising from or in connection with them falls under the exclusive jurisdiction of the courts of the judicial district of East Flanders (Dendermonde division).
